Oregon Real Estate Agency Disclosure Pamphlet

As a broker or in my case a principal broker, it is the broker’s job to represent you whether buying or selling with the utmost care in that representation.  This disclosure explains a broker’s duty to you as a buyer or seller. A broker is required to give you this pamphlet after “first contact”. (Do not print – I will provide you with one) The following is from the Oregon Real Estate Agency:

“A licensed real estate broker or principal real estate broker is required to give a copy of an Initial Agency Disclosure Pamphlet to each consumer the broker will represent. The pamphlet describes the legal relationship between a broker and the consumer when the broker acts as the consumer’s “agent.” Real estate brokers and principal real estate brokers have legal obligations, called affirmative duties, to both buyers and sellers in a real estate transaction. For purposes of this rule, “at first contact” means at the time the agent has sufficient contact information about a person to be able to provide an initial agency disclosure pamphlet to that person. Contact with a person includes, but is not limited to contacts in person, by telephone, over the Internet, by electronic mail, or by similar methods.”

Oregon Real Estate Sale Agreement

If you have looked at 1 home or 20, at some point you hope to find your home and then the fun begins!  The OREF (Oregon Real Estate Forms) Real Estate Sale Agreement use to be 1 page in length. Through time and I’m sure many court cases, the sale agreement is now 11 pages long. I have to say, yes, it’s much longer but it covers so many areas that used to be gray areas.  There is much more clarity for you as a buyer.  You must understand this agreement and it is my job to make sure that you do.  This brochure highlights very important areas in the sale agreement. Lead In Your Home Brochure

If you are thinking of renting or buying a home that was built prior to 1978, brokers are required to provide this pamphlet to you as a buyer.  If the home you live in was built before 1978, you as a seller must disclose any known information regarding lead in your home. The disclosure is long but is a wealth of information.
